OVERVIEW

A proposed class action lawsuit was filed in the Yukon against the Government of Yukon, the Department of Education and the Jack Hulland Elementary School Council of Attendance Area #22, (the “School Council”).

The proposed class action has now been certified for settlement purposes against the School Council, and certified to proceed as a class action against the Government of Yukon

This action arises from the systemic use of holds, restraints and involuntary seclusion to control students’ behavior at Jack Hulland Elementary School (“Jack Hulland”) beginning in, or about, January 2007 to about June, 2022.

The Statement of Claim in the lawsuit has been amended.

The Class

The class action is brought on behalf of all students and former students of Jack Hulland who were subject to holds and restraints and/or who were locked in a room and/or placed in seclusion between January 1, 2007 and June 30, 2022.

 

settlement

The claim against the School Council has been settled.  The settlement ends the law suit against the School Council in exchange for providing cooperation to the plaintiffs in the nature of documents and information.  The class action will continue against the Yukon Government.

Certification against the Yukon Government

The contested litigation is continuing against the Yukon Government.

The application to certify the action as a class proceeding against the Yukon Government was heard June 26 – 27th, 2023. On September 6th, 2023, Chief Justice S.M. Duncan of the Yukon Supreme Court provided the Reasons for her decision certifying the law suit as a class action against the Yukon Government.
